ILG: Class Actions Insights

Class action litigation is growing in volume and value across every major jurisdiction. ILG member firms provide the local expertise and global insight insurers need to understand and manage the risk.
Class actions, also known as representative proceedings, group litigation or collective proceedings, depending on the jurisdiction, allow large numbers of claimants with common grievances to pursue a single defendant or group of defendants in consolidated proceedings.
Once primarily associated with the USA, class action mechanisms are now also firmly embedded across many of the world’s other major legal systems, including Australia, Canada, the UK, Europe and much of the Asia-Pacific region.
For insurers, class actions present a costly challenge. Individual claims that might otherwise be manageable in isolation often threaten entire towers of insurance when aggregated.
A single class action can expose an insured, and its insurers, to liability running into hundreds of millions or billions of dollars, together with substantial defence costs.
Our member firms share their perspectives on the class action landscape in their jurisdictions and the risks they see emerging for insurers and insureds.
